One of the major influences in today's real estate market is the foreign buyer. So buyers and sellers who are buying in Canada or the United States need to know a few things before they make their move. Real estate is a very big investment, but before you move ahead, here are ten things that you need to know. #1 Multiple Listing Service Canada and the United States have what is called a Multiple Listings Service. That means that you can work with one agent who can show you all the listings in his office or her office and they can also show you listings that belong to other companies. So there is no need to shop for a number of agents: you can use one agent, and that agent can show you as many properties as you would like to see. #2 Listing Agent Sellers enter into a contract to list their properties for sale with one agent, called the listing agent. #3 Buyer Agency Agreement (Buyer Representation) Buyers can enter into contracts with what we call a Buyer Agency Agreement (buyer representation). This means that the buyer agent's fiduciary duty is to you as the buyer. That means that they have to protect your interests, they have to make sure they have all the information, and they are on your side in a number of transactions. So buyer agency and buyer representation are very important in North America. #4 Funds On Shore Make sure that you have funds transferred into a Canadian or a U.S bank, so you are ready to move ahead with a transaction if you see something you like. You need to make sure that your funds are on shore before you make any sort of deposits or down payment and transactions. Don't expect that your funds can be transferred within a day or two. They should be in North America and ready for the purchase. #5 Deposit You will need a deposit. A deposit is cash or certified funds, and that money has to go into a bank account with the listing brokerage. The deposit is between 5 per cent and 10 per cent of the purchase price and should be fairly accessible from your bank account and to the trust fund of the listing company. #6 Financing If you need financing, you will have to be pre-approved by a bank with branches in Canada. There are a lot of foreign banks in Canada and you can use them, but the process will be much easier if a lot of your assets are already transferred into Canadian funds or in a Canadian bank, or in U.S funds in a U.S bank. #7 Land Transfer Tax Buying property in Canada and the United States is like buying property in many other places — there are taxes to pay. Here, we have taxes on the property that are paid yearly. There are also taxes that are paid when you actually buy the property. And in Toronto at the moment, there are two taxes to pay. One is a 2 per cent tax on the purchase price that goes to the province and the other is a 2 per cent tax that goes to the City of Toronto. You have to be prepared to pay to these taxes on closing. #8 Property Tax & Withholding Tax Owning property in Canada and the United States means that you will have to pay property taxes. Taxes on most properties are a factor of the size of the property and the value of the property. Here, the tax is based on a percentage of the value of the property. And usually, that is 1 per cent of the value of the property you pay in taxes per year. But that is a figure you should keep in mind. When you sell your property, you will be subject to withholding tax, and that withholding tax will be relinquished once the government assesses your tax liability. #9 Responsibility To The Mortgage Please remember that when you buy a property in Canada and it's financed and you have a mortgage, the mortgagee can go after you for all of the value of the mortgage that you've borrowed. So you are responsible to the mortgagee to pay that money back. #10 Agreement of Purchase and Sale Please note that an accepted Agreement of Purchase and Sale is a binding contract. It's not something that you can walk away from, nor do I suggest you ever walk away from this. Buying in Canada has been very possible for a lot of people, and Canada is a very safe place to live — a very safe place to put your money. Please note that any time you buy a property in Canada, it comes with strong property rights. It is very hard for someone to take that property away from you unless you do not meet your financial commitment. Canada is a very strong, safe place to invest. Today's real estate trends video is about what seems to be a seldom asked question yet is vital to successfully closing on your new home. Hence the "original" title, "what are buyer and seller closing costs?" Whether you are selling a house or in home buying mode, you should know everything can about what are buyer and seller closing costs. If you're in home buying mode, please ensure you ask your local real estate consultant and local loan officer about buyer closing costs. It's a safe rule of thumb to estimate 3% of the sales price. You may be wondering about buying a home closing costs and where that money is applied. In this video I share 11 areas buyer's have more line item closing fees than a seller. At the same time, it is the seller who will ultimately incur more seller closing costs than the home buyer. Even though closing costs for a buyer are plentiful by line item they amount generally doesn't exceed 3% on average. It's important to note when asking what are closing costs on a house to understand that your buyer closing costs are separate and distinct from your down payment amount. Your local loan officer should provide you with a loan estimate upfront before to you get to far along in the process. Many buyer's may be approved for a higher mortgage but may not be comfortable with the monthly mortgage amount. Better to enjoy your new home than to be house broke! Something to consider... Let's say folks in the home buying mode would like to estimate an out the door cost for their new home. Let's say a family is approved for a traditional FHA loan with a 3.5% down payment and are buying a $300,000 home. Here's an example: $300,000 * 3.5% Down Payment = $10,500 $300,000 * 3% estimated buyer closing costs = $9,000 Our fictitious folks above should be prepared for an out the door cost of $19,500 when buying a home in this example. Now, you may asking, "Can the closing costs be paid by the seller?" In short, yes... Keep in mind that buyer closing costs and are called BUYER CLOSING COSTS for a reason... The seller has their own seller closing costs to contend with and are paying the lion's share of closing costs in general. Depending on your local market conditions and the competition for your new dream home will greatly factor into successful negotiations with the seller to pay some or all of your buyer closing fees. This is more common in a buyer's market. At the time of this video (9 Aug 2017) US real estate is sharply trending as a seller's market so be prepared to pay your own buyer closing fees. As a buyer it is important to fully understand that over 99% of real estate agents work on commission only. That being said, the vast majority of home seller's pay the buyer broker commission. So the excellent professional services of your buyers agent aren't costing you a thing unless agreed upon upfront by you and your agent. (In most cases, the buyer broker generally accepts the commission being offered by the seller so long as it means the brokerage minimum requirement) Another, lesser known, option to buyer's it the possibility of rolling your buyer closing costs into your mortgage. Be sure to ask your local loan officer to see if that is an option for you and to fully explain both the pros and cons of how this impacts your mortgage overall. If you're a seller and you've made it this far... Great job! Now, let's take a look at what are closing costs for a seller... The biggest portion of this will be the total listing commission agreed upon by you and your listing agent. The reminder will consist of real property transfer tax, title insurance, prorations, property taxes, etc... For a more detailed breakdown of your estimated costs of selling a home contact your local real estate consultant. Please keep in mind, the adage: "you get what you pay for," is very true in real estate. Don't be fooled with the 9% fees of Offerpad and Opendoor. Ask your local real estate agent first. If you are less motivated then the other party then you have more power. And if the home is not priced at market value then as a buyer you have power and and a seller you do not. So once you figure out the buyer's or seller's motivation and the market value of the property you need to watch out for these 3 scenarios: 1. Verbal Statements The other agent, home buyer or home seller might tell you something when you are walking through the home. It might sound great and help you make a decision to move forward on the deal. But when you sit down at the negotiating table you might hear something totally different from another party. The best way to avoid this good cop/bad cop routine is to get everything in writing. And then have it signed off by all parties. Then you know you have a done deal! 2. Multiple Bid Situation. As a home seller you should be elated. As a home buyer you will be depressed. Multiple bid situations usually end up with the home selling for more. So as the home seller who wants to sell your home for the most money you should aim for this situation. You can do this by: -pre-marketing the home. "Coming Soon". Will build up excitement for the home and could net you more interest when the home comes available. And a multiple bid situation. -Pricing the home at or below market. This seems counter intuitive. But combined with pre-marketing the home you can get a line of buyers and a higher than list price offer. -Letting everybody know you have an offer. If you have an offer coming in then let everybody who has seen the home know. They might of been on the fence and this is what they need to get them to put in an offer. You also want your Realtor to contact all the Realtors who have clients registered in the MLS with search criteria that matches your home. 3. Endless Request Everything starts out fine. Then the other party, buyer or seller, ask for one more thing. Then one more thing. Then one more thing. This can derail the whole deal. It's best to get along as much as you can but if you have the "Endless Request" then you need to put a stop to it. The easiest way to do that is to explain you have a lot going on with the move and have already everything planned according to the contract. I'm going to talk about that and how to build one in this video. "Joe, I have a question. Could you go over the mechanics of setting up a database for buyers or sellers or whatever so as to make it useful for me?" -- Tony DeFonzo Joe: Tony is one of my mentor students. Let's just talk about the actual structure of a database. You're going to want to create lists of buyers, sellers and investors, at a very minimum. These lists can be worth a huge amount of money for you. I have 50,000 investors on my list right now. I sell them rental properties, investment properties and I sell them information on how to invest in real estate, and it's very, very profitable, so you'll definitely want to build a list. Joe: What I suggest you get is a 'CRM'. This is a 'contact relation management'. Basically, it allows you to put in their contact information and keep information about each contact that you have. Joe: But in addition to a CRM, you'll want to have an autoresponder. An autoresponder is a sequential email program. It sends out a sequence of emails to a particular person, depending on what category they're in or what group you put them in, and you can create different sequences for different types of groups, depending on what you're trying to sell them or trying to do with them, and then that autoresponder will then send them emails on a regular basis to keep them up to date. Joe: Every one of you is in different autoresponders in my database. A lot of you get lots of emails from me, emails that I don't sit down and write every day that I've written over the years and added to this database, e.g. articles, videos, all of this stuff that I send to to build a relationship with you. It's really not about how many people you know -- it's not about who you know -- it's about who knows you, so try to get it out to as many people as possible with your information and have them feel that they know you. Joe: What I'm doing with these videos is building a relationship with you. I learned this from watching my sister. My sister was on a soap opera on General Hospital for about 18 years. She played a character called Felicia. Back in the 80's, when I would drive around with her in L.A. (because I lived in L.A. at the same time and we used to spend an awful lot of time together) -- people would come to her all the time and they would feel like she was part of their family because they saw her on TV all the time. They saw her in Moat. They saw her as a real person, and they loved her and trusted her. They'd come up to her and would be star struck, but they would also treat her like family. Joe: Now, that was a great lesson for me, because I learned that through video, and through my writing and audios, that I could build a relationship with people that I don't even know, and that it would make them feel that they know me. Joe: You can do the same thing with your database. Once you create this list and autoresponder, you can then send out emails to them, you can create videos if you want and you can create audios if you want, you can use the ones that I've created for you and it'll build the relationship so that when they finally start dealing with you and decide that what they want to work with you or do the things that you're suggesting they do, they already come to you knowing who you are. This is a very vital process. Joe: Getting back to the mechanics of building a database: use one of my favorite autoresponders -- 'AutoResponse Plus'. Use that database; it's a great way to do it. I also use a company called 'Infusionsoft', which is also very good, but also very expensive and probably not necessary for you unless you're building a fairly large business.
